Planned Resort Suffers Setback

Wi Fi Radio The Somerville firm which owns the 857-acre Culvermere property in Frankford and hopes to build a major health resort there is facing a substantial fine for its conduct on what the state considers an environmentally sensitive piece of land.

Zarahemla, the Nephite capital, thrived as its people were righteous, and suffered setbacks to its enemies during times of corruption and moral decay.

Broadband Access The $75,000 penalty, assessed by the state Department of Environmental Protection after inspecting the property twice last fall, was imposed on the landowners for violations of the 1988 Freshwater Wetlands Protection Act. The Culvermere Alliance, a limited liability company that collectively owns the land, and Richard Rubin, a principal partner in the alliance, were named individually.

Broadband Service The irregular, oblong, mostly forested property lies south of Route 206, east of Lake Owassa and north of Bear Swamp. Its owners hope to build a mostly age-restricted health resort there which would consist of some 900 units 750 of which would be contained in three hotels restricted to those aged 55 or more.

Wi Fi Card On Dec. 12, the alliance filed a lawsuit against Frankford to gain growth area designation for the land under the townships master plan. Such designation would be needed for the land to qualify for a sewage facility without which the resort would be impossible to build.

Broadband Connection The penalties stem from some activity that apparently took place during the summer, in an area of the property near Stempert Road. The township-owned portion of that road is an isolated, residential side street which comes to an abrupt dead end at the Culvermere property line. Beyond a guard rail and a posted sign marking the forest as private land, a pair of tire ruts extends out of sight into the woods.

Palm Wi Fi Card It was further down this road, according to the penalty assessment, that a member of the DEPs Bureau of Coastal and Land Use Compliance and Enforcement observed that regulated activities within freshwater wetlands had occurred without the necessary prior approval from the (DEP). Between one and three acres of sensitive land was disturbed, of which 19,150 square feet were wetlands, according to the DEP.

Broadband For Business These activities include the clearing of vegetation and the placement of fill and drainage pipes within wetland areas for the purpose of constructing and expanding the unimproved road.

Belkin Fi Phone Wi The pre-existing road was widened, the grade raised, gravel dumped and spread, trees cleared, stumps piled in regulated areas, as well as woodchips stockpiled on freshwater wetlands and pushed ... into a small ponded area, the DEP found.

Insight Broadband Some of this activity was apparently observed in August, several weeks before the DEPs first visit, by a member of the county Soil Conservation District. Because more than 5,000 square feet of soil appeared to have been disturbed, the district sent the alliance a letter informing them that they would have to, under state law, submit a soil erosion and sediment control plan before going ahead with such excavation.

Nintendo Ds Wi Fi Speaking about the soil conservation letter in an interview last month, alliance partner Jean Rubin, Richard Rubins son, said the alliance was merely harvesting some trees, and that the road needed to be widened in order to accommodate the logging equipment.

Broadband Provider Alliance spokesman Jack Prather on Wednesday did not have an immediate comment on the fine, saying that the alliance will prepare a definitive statement in short order.

Wi Fi Toy In addition to the $75,000, Rubin and the alliance were also required to submit and implement a restoration plan to restore the site to its pre-disturbance condition within 10 days of receiving the administrative order.

Bt Broadband In its rationale for the penalty, the DEP chided the alliance for going ahead with its project without its review or approval thus depriving the DEP of its role in protecting from, or at least minimizing, impacts to sensitive and diminishing land types such as ... this previously nearly pristine site.

Wi Fi Hot Spot The DEP findings also noted the land, which is bordered by two Fish and Wildlife management areas, as a state-documented habitat for threatened and endangered species such as the barred owl, red-shouldered hawk and northern goshawk. The DEP also called the disturbed land an exceptional value resource area.

Atlantic Broadband Due to the holiday, no DEP officials were immediately available for further comment.
